Essential items every tenancy agreement must include to comply with UK law
Required by Law
- Landlord name and contact address
- Tenant name(s)
- Full address of the rental property
- Start date of the tenancy
- End date (for fixed-term tenancies)
- Rent amount and payment frequency
- Rent payment date (e.g. 1st of each month)
- Deposit amount
- Which government-approved deposit protection scheme is used
- Notice period required by both parties
- Governing law (England and Wales)
Obligations and Responsibilities
- Tenant obligations (maintenance, no subletting, no alterations)
- Landlord obligations (repairs, gas safety, quiet enjoyment)
- Access for inspections (minimum 24 hours notice)
- Utilities and council tax responsibility
- Furnishings and inventory reference
- Data protection and privacy statement
Optional but Recommended
- Pet clause (whether pets are permitted and conditions)
- Break clause (option to end early and after how many months)
- Garden maintenance responsibilities
- Number of permitted occupants
- Smoking policy
- Special conditions specific to the property
Deposit Protection: By law, all tenancy deposits must be protected in a government-approved scheme (DPS, MyDeposits, or TDS) within 30 days of receipt. Failing to protect the deposit can result in a fine of up to 3x the deposit amount.
