Essential items every tenancy agreement must include to comply with UK law

Required by Law

  • Landlord name and contact address
  • Tenant name(s)
  • Full address of the rental property
  • Start date of the tenancy
  • End date (for fixed-term tenancies)
  • Rent amount and payment frequency
  • Rent payment date (e.g. 1st of each month)
  • Deposit amount
  • Which government-approved deposit protection scheme is used
  • Notice period required by both parties
  • Governing law (England and Wales)

Obligations and Responsibilities

  • Tenant obligations (maintenance, no subletting, no alterations)
  • Landlord obligations (repairs, gas safety, quiet enjoyment)
  • Access for inspections (minimum 24 hours notice)
  • Utilities and council tax responsibility
  • Furnishings and inventory reference
  • Data protection and privacy statement

Optional but Recommended

  • Pet clause (whether pets are permitted and conditions)
  • Break clause (option to end early and after how many months)
  • Garden maintenance responsibilities
  • Number of permitted occupants
  • Smoking policy
  • Special conditions specific to the property

Deposit Protection: By law, all tenancy deposits must be protected in a government-approved scheme (DPS, MyDeposits, or TDS) within 30 days of receipt. Failing to protect the deposit can result in a fine of up to 3x the deposit amount.
